Legal heir certificate for deceased sister

Dear Experts,

I am sangeetha from chennai, my hometown is trichy. My mom n uncle lived there. since my uncle is unmarried he lived with my mom till the day he died (29/1/2011).I am in the process of getting his death certificate.he has left LIC with my mom's name as nominee.Also he own a property which i would like to get it transfered to my mom's name.since he has not written any will..kindly let me know the procedure for getting legal heir/succession certificate since my mom comes under legal heir category 2 as mentioned by our village officer..since my grandparents are no more and my mom is the only sister for my uncle pls help me how to proceed...pls..

File petition for getting succession certificate in the court.

for movable property you have to file petition for getting succession certificate and for immovable property you have to obtain declaration from Court in your mother's name.

you have to file the petition for obtain the succession certificate in Civil jurisdictional court n also file a suit for declaration of legal heir .

Village Officer told is right.Village Officer can issue legal heir certificate. You have to move before Civil Court for Succession Certificate.

However, LIC is bound to settle the claims to the nominee and discharge its liability. However, If there are other legal claimants then they can represent the matter to the court for recovery.
