This query is : Resolved
My dad recently expired and we applied for legal heir certificate. Myself, my sister and mother are officially legal heirs. But when the certificate arrived, 1. Our initials were not present ( for myself, my sister & my mom) 2. They've included my dad's deceased mother as the fourth legal heir. Will this create any complication in the future? What does this mean? And my dad has a brother & his children who are still alive and one sister who's deceased, but have children. Will my dad's brother's family have rights to claim my dad's assets?

The first heir of the deceased is his mother. Wife, sons daughters come thereafter. Btothers, sisters and their children don't have any right in the property of the deceased.

it is believed that you are Hindu. ClassI legal heirs are; Mother, spouse, sons and daughters.
Since ClassI legal heirs are present they alone shall share the wealth of the deceased.
It is good to see that some authors do come to post their thanks to Experts.
