Legal heirs petition after death of one plaintiff

(Querist) 13 December 2013 This query is : Resolved

Sir,

There are two plaintiffs in the partition suit and one plaintiff died. What is the procedure for 2nd plaintiff who died at the stage of final decree proceedings and advocate commission appointment and how to bring their legal heirs on record holding registered Will in the place of demised plaintiff. I have doubt about the abetment of suit. What is the time limit for bringing the legal heirs on record in C.P.C.

Please kindly advise and oblige.

Thanking you,

Legal heirs can always be substituted in place of original plaintiff as per order 22 rule 4 of cpc.
