Dear Sir,
I would be very much thankful if you could give me your expert advise on the following points.
The complaint have been filled U/s.138 of NI Act 1881 and time have been taken from the Hob'ble court for paying court fees stamp in the case.
Meantime the complainant has received full amount of the dishonored/disputed cheque from the accused. The complainant wants to withdrawn the case.
Would like to know exact procedure...
Whether complainant have to pay the requisite court fees before withdrawing the case?
Can he withdraw case without paying court fees?
Please advise at the earliest.
