Liability of deceased father to son

(Querist) 09 December 2012 This query is : Resolved 
Dear experts kindly advice on the below subject matter:
1.If father dies and there is an income tax case pending on the father on scrutiny, does the liability to appear before the Assessing officer or any authorities fall over to the Son ?.
2.And if the father dies in the process of finalising the case pertaining to the case is there any law which prohibits the sale of any immovable properties by the legal heirs ?
Kindly advise on the same.

1. Only civil liability is fastened upon the legal heirs inheriting the property of such assessee.

2. No. If the deceased had any liabilities of IT, that is required to be recovered out of his properties left.

on death of father legal heirs can dispose of his immoveable property after follwing due porcess of law . if son has inherited property fromhis father and their are liabilites he has to pay the same to extent of his inheritance
