Limitation Act 1963

Hello,

I am interested in knowing about this Limitation Act 1963.

1. Are there any amendments to this act. 2. What are the terms under which a person who has possession of a plot of land can stake his / her claim on the property.
3. What is the procedure to be adopted for staking claim under this act.
4. What are points to be taken care while staking claim.

Does this also apply to land owned by MHADA in Mumbai.

Also part of the land which was cultivating has been now developed by MHADA. I am only left with near half of the land under the survey no.

I have been staying on this place from 1986.

What is the procedure for filling for Adverse possession.

Your quarry separately raised over the matter of MHADA land has already been given.

Limitation Act applies to all laws. In case of government land if there is uninterepted and continues possesion for 30 years you can file suit for adverse possession. You must give notice u/s 80 before filing any suit against the Govt.

Dear Raj Sir, Vishal Sir,

I am grateful for your support and guidance. As mentioned in my other query, this land is owned by MHADA.

The persons cultivating the land are of SC background.

I seek your guidance on how their rights can be protected as they are not familiar with the Law.

On talking to my friends I was advised to seek adverse possession under the Limitation act.

I am not sure what is to be done.
