Respected Sir,
First pl accept my wishes & greeting for your excellent servise.
I Though I am not a party to the above query / answer- on 16-1-2010 on this subject- If a married man stays with a lady - under living together he can be punished - very fine . BUT WHAT ABOUT THE LADY WHO IS SPOILING HIM - OR WHAT IS THE PUNISHMENT FOR HER / OR NO PUNISHMENT AT ALL ?????

Though the live-in-relationship has been recognised by GOI as depicted in The Prevention of Atrocities of Women Act. 2005 and there is no question of punishing anyone therein but on the other hand section 294 IPC bounds both of them to be punished if either of them have re-married without obtaining divorce from their earlier partner.

If the lady is married it is as you say. But if she is not married - then what will be the position ?

Unfortunately under IPC a lady cannot be booked under Bigamy or adultery case.

All the trouble starts only when the lady living with the man raises a complaint and until such time the man is not liable for any punishment. In large number of cases Dowry Prohibition Act, Domestic Violence Act etc., are all being misused by women to take revenge against the husband. So if a woman decides to harass her husband, she has very good weapons to do so even against innocent husbands. In a similar fashion, in living-in relationship also, woman can take revenge against the person with whom she is living but on the contrary the man living with her has to be submissive. A national debate is due over this issue.

Lady can not be booked under Bigamy.
