what is the difference between Judicial Magistrate of first class and Judicial Magistrate of second class?

JMFC is equivalent to a Civil Judge Junior Division. I have no t heard of JMSC.

a new magistrate when he joins is given the power of judicial magistrate 2nd class and he is authorized to pass sentence of imprisionment for a term not exceeding one year or fine not exceeding five thousand rupees or both

after some time he is given the power of judicial magistrate 1st class and is authorized to pass a sentence of imprisonment not exceeding three years or fine not exceedin ten thousand rupees or both.

May be when there are more than one magistrate in the court, then magistrate is reerred on the seniority

Dear Bindia, In Kerala there is only one catagory Judicial magistrate of the first Class. The 2nd class was abolished. Powers confired are in the Cr.P.C You may go through the 1st schedule of the Code. There is only two calsses in the schedule. 1st class Magistrate and any Magistrate. Deepak expresses the practical side. Hope you are cleared.

Even in Karnataka there are only JMFC's and no JMSC.

It is a jurisdiction of a magistrate to take congniance of an offence. A magistrate of second class can pass a sentence upto1 year and fine upto rs.5000.00 and that of first class can award a sentence of upto three years and fine upto rs.10000.00
