Mainability of reply from cpio during pendency of appeal u/s 19(1)

Dear Experts
After expiry of time limit of 30 days and after filing an appeal u/s 19(1) before the Appellate Authority, if a reply is received from CPIO/SPIO during pendency of appeal, kindly indicate whether the reply of the CPIO/SPIO is maintainable under the RTI Act 2005.

The aim of the application or the appeal is to get desired information and if the same is provided during the pendancy of the appeal. what harm the appellant/applicant shall suffer?

The information provided so first chapter gets closed and the matter of penalty may run thereafter.

Rs.250/- per day penalty shall be leviable. Reply of course delayed one can be used in all proceedings.

The CIPO/SIPO will represent the same to the Appellate Authority that they have provided information. What you require is information and that is provided. So the appeal is of no use. If you are not satisfied with the reply, you have initiate fresh course of action by making an appeal that the information is sought is not provided though the reply is received albeit late.
