Maintenance charges in apartment

Sir, we have been owned/staying in an apartment containing 15 Nos. of flats (1st floor commercial space; 2 to 5 floors residential in which 4 flats of 1720 sq ft (3BR/3 Toilets) and 8 flats of 1060 sq ft (2BR/2 Toilets) but all flats are paying ₹1000/- flat rate of monthly maintenance charges. Pl guide us to arrive optimum assessment of charges to be collected from flats in the Apartment.

There can be no. of ways to decide the quantum of maintenance charges. Let the society discuss and arrive at some conclusion. May follow the process nearby societies are following.

Usually, societies collect maintenance charges equally for 3BK and 2BK without any exceptions for the flats with fewer measurements. However, check your bylaws for terms and conditions. And as advised by the learned expert Mr. Rajendra Goyal sir inquiry in your town/city.

No straight jacket formula / rule exist to fix maintenance charges. It is mutual decision of the residents/ occupants for creating necessary facilities for their own comfort.

To my knowledge, maintenance charges needs to be collected at uniform rate irrespective of area of the apartment.
