Managing committee resolution

(Querist) 02 March 2013 This query is : Resolved 
My society had passed a resolution against extending flower bed in window sill in August 2012.However; prior August 2012; some members had extended their flower bed & no action has been taken against them post resolution passing. In Feb 2013; when i tried to extend the flower bed; Secretary along with Comm Members has stopped work in my house. They have asked me to restore flowerbed in its original condition & given me ultimatum for 15 days ; post which i have to pay Rs 500 / day as fine. They have also stopped carpentry work [ totally unrelated to flowerbed ] in my house.

Query is: Whether Managing committee is justified in passing the resolution & giving the ultimatum & imposing fine? Also; what is the legal status for those who extended flowerbeds prior resolution passing? What legal stand i should take?

There may be General body meeting held of your society, in that meeting members are also invited . In that meeting, you raise your problems/issues and ask explaination from Secretary and Chairman. Also bring into their notices, that how others are allowed to extend flowerbed with objection.

You cannot take shelter of your illegal act of the members who prior to passing of resolution extender their flowerbeds. Society can pass such resolution. You may insist to implement the decision impartially over all members and may insist to treat at par with you so that the income of the society may also increase.

write a letter to SEcretary . give detailed particualrs of members who have extended the flower beds . ask the secretary what action has been taken by the society against said members .

if no reply received send reminder .

then lodge complaint with muncipal corporation against society and said members
