Sir
My mother sold in 1990 maternal ancestral property in the capacity as herself and as guardian for me while my father is alive. My father did not sign the deed for us.who can be guadian my father or mother. Then she filed a suit for cancellation of the sale deed for fraud, the case is still pending. Now my question is Whether the period of limitation of 3 years from the date of majority counts from the date of majority or the date of finalisation of that case whih is pending.Kndly advice sir

majority is not based upon the decision of any pending case. If you have attained the majority, initiate legal action within its 3 years.
I could not understand, how you or your father can become shareholder/co-sharer in the property inherited by your mother from her mother side? She is still alive so she is the exclusive owner of her property and she might have not sold it by becoming your guardian etc. Please again go in depth of the facts of the case.

i agree with Mr. Makkad, ur mother recieved the property in her personal capacity, how u and ur father came into picture????
legally such a property is her own exclusive property.
