I HAVE BEEN WORKING IN GOVT BANK SINCE 2011
I AM ON PROBATION. TWO MONTHS REQUIRE TO COMPLETE THE PROBATION
I WAS INVOLVED AN CASE UNDER IPC 326 IN 2007 AND IN PRISON FOR 24 HRS TILL GOT THE BAIL.
THE CASE IS RUNNING IN TALUKA(TEHSIL) COURT.
BANK ITSELF TOOK THE POLICE VERIFICATION CERTIFICATE FROM POLICE DEPT DIRECTLY AND POLICE DEPT DID NOT DISCLOSE ABOUT MY COURT MATTER IN VERIFICATION CERTIFICATE.
THERE IS NO FILLED ABOUT COURT MATTER IN ANY BANK'S DOCUMENT WHICH I SUBMITTED TO THE BANK,SO I DID NOT DISCLOSE TO THE BANK ABOUT MY COURT MATTER.
NOW OPPOSITION PARTY SENT THE APPLICATION WITH F.I.R TO THE MY BANK FOR TERMINATE ME FROM THE BANK.
WHAT ACTION BANK TAKE ON ME?
CAN BANK TERMINATE OR SUSPEND ME OR NOT?
WHAT ACTION SHOULD I TAKE?
PLEASE GUIDE ME I WILL BE VERY THANKFUL TO YOU

Unless and Until you are convicted in the case bank would not take any action and bank had directly taken the Report from Police and you are not responsible for it.See that you get acquittal in the case with competent advocates.Regarding Bank issue consult a senior lawyer explain every thing and be protected.Regarding the opposite side attempt to damage your livelihood make an additional petition to the court where the case is going on Consult your Lawyer

Since as per your version you have not suppressed any information from the Bank, you have not been convicted, if bank ask for any explanation consult some senior Service matter lawyer.

Since the matter is still pending and no decision has been arrived by the court on charges framed against you, it means you are not held guilty of the offences by a court. Mere FIR and court case is not a ground or reason to terminate your employment/service. Further since you have not suppressed the facts material to the employment purpose, you do not have to worry about it, in case of any notice from your employer, take the help of a local lawyer and issue proper reply to the show cause notice.

If you had concealed the information about your court case while filling in the attestation form for the purpose of police verification, the SBI can terminate you any time after conducting a departmental inquiry. Otherwise, the bank will wait for the decision in the case for further necessary action.
