Querist : Anonymous (Querist) 03 February 2010 This query is : Resolved
sir, i wish to know the easiest way to get the property transfered/ mutated in my name.
the said property was in my mothers name who expired in 2002 , she has left a registered will in my favour. i have 4 sisters one of them lives abroad. i am applying to the mcd for mutation in my favour , i have also with me the Noc affidavits ( notorised) of the current dates from all my sisters. is this the correct procedure to get the property transfered in my name or is anything else is required .

If it is a city property you need to probate the will otherwise not necessary. You can approach the revenue officials with all relevant records and mutate the property records to your name.

I think since the property is in delhi(city) the will should be probated. First probate the will.

Relinquishment deed is a deed in which one or more parties relinquish (give away) their rights to another. In your case your sisters may give a relinquishment deed in your favour all their rights over the property.

But for gaining complete ownership of the property relinquishment deed is not sufficient, you need to probate the will. Contact an advocate for probating the will.

If the property is ancestral only then relinquishment deed is allowed and all 4 sisters shall be required to come and attend the office of registrar at the time of execution of such deed.

On the other hand, you can probate the will making all sisters as plaintiffs and general public only as defendant wherein also only a short period shall incur and matter shall end accordingly.
