Muthoot finance- Regarding cumpalsion of Extra working hrs

My wife is working in muthoot finance ltd,pune & she is a permanent employee since 5 years.

Her regular official duty time is 9.00am to 6pm(9hrs). There are 3 female employees & a male employee working in her branch.

Sir, Since 6 months company forcefully ordered them to work upto 7.30pm & told that while leaving office a phone call from office telephone should be done in main branch daily to confirm whether they worked for extra hrs or not. It means to work more 1& 1/2 hr extra & No extra pay or allowance provided by company for this extra time work.

One day agrived by this hectic extra hr work, my wife called main branch and said that due to mental & physical stress after 9 hrs of continues duty, all staff have unable to do work upto 7.30pm. In shocking response to this, the main branch manager told her if u are unable then leave the job, we ll recruit new candidates. You have to stop upto 7.30pm.

Sir, I ve some questions
1)Is their no criteria for regular working hours?
2)Is their no provision for women employees to exclude from this type of conditions of working more than duty hrs?
3) The employees of this muthoot finance are not dare to do any complaint against company,as everyone wanted their job secure. Then in this condition how can they fight against these types of company rules?
4) Whether there is any labour law which ll claim the OT hrs for private financial company ?

Yes, there are laws and remedies; but who will dare to to bell the cat? Only collective efforts can solve the issue.

Muthoot finance is a private company. The working hours are generally decided by the company authorities, but if the working hours are decided at the time of the recruitment and if extra work load and time is imposed over the employees, then the law is applicable to get the relief. The company cannot just terminate anyone for no valid reason. Send a legal notice to the employer mentioning the facts and send a copy to the dy. commissioner of labour of pune city.

Private companies adopt such tactics, your wife should prefer to search another job.

She may mark attendance for the time she worked and claim overtime. She should tactfully try to get official instruction to work till late. Normally such company never instruct in writing. She should inform controllers while leaving office late quoting their instructions and record the telephonic conversation.

However, in such circumstances, company may file even criminal case true or false on small grounds or may target otherwise.
