My ex wife is not submitted document which is in her custody

Sir,
I am fighting of child cutody in the court, I am Bhilai Steel Plant eployee. On aug 2006 she left my girl child when she was in 101degree Centigrdae fever. I have given the letter to the court that OPD book in her custody so court has given order that to submitt that document in which Aug 2006 child got medical tretment. Then she made a new one and she submitted new OPD book.
In the family court i have given again Order 11 rule 14 application then she denied with affidavit that old OPD book has not in her custody. Again i have applied Order 11 and rule 21 application then again she denied that OPD book in her cutody.
I have given the document during argument that in same court she has applied one application for renewal and I have applied RTI and submitted in the court that she used that document in the hospital and she made new one on 2009.
My qu. is:-
1. What will be effect on my child cutody case?
2. Weather she has done any criminal offence?
3. What type of criminal offence that thn what i will do, becaise Family cort can not run Crminal case? what step i will do?
4. Weather i can go to the High Courst? But i want to know which type of offence she has done and for what i will applied?

Dear Mr. Reddy,
Leaving the girl child when she was suffering fever is not an 'offence' at all.
In any case, that alone is not good enough to deny the child custody to the mother. In fact the girl child upto certain age would be given custody only to her mother. The mere fact that your wife had left the child when she was suffering fever of 104 degree etc. alone will not be a great ground to deny the custody to your wife. The other acts of your wife by obtaining OPD etc., etc., will only show her in poor light, but again that will not be a great thing especially in child custody matter.

custody of child is generally awarded to mother . you should ask for child vistation rights during weekends and holidays . donnt waste your time and money ion going to HC
