Ni 138 cheque bounce case against lawyer

(Querist) 12 July 2024 This query is : Resolved
I have initiated a cheque bounce case against a person who incidentally happens to be a practising lawyer in the same Court, where case is being filed.
In such event, can he(advocate}as an accused ,be objected by Complainant to not appear in Hon'ble court in this specific case proceedings in Advocate's dress?
T. Kalaiselvan, Advocate (Expert) 12 July 2024
He can very well appear as party in person for his own case but he cannot appear as an advocate for his own case.
You can very well record your objections before the trial court.
Advocate Bhartesh goyal (Expert) 13 July 2024
A Lawyer, being party to the proceedings can appear and defend the proceedings himself in his own capacity as a party in person.
ashok (Querist) 13 July 2024
question here is not of his appearance as accused before the Hon'ble judge but question is
"will the Court allow him in Advocate attire(s) "
T. Kalaiselvan, Advocate (Expert) 13 July 2024
Answer was given clearly in my post that he can appear as party in person, in that case he cannot wear the advocate robes while attending this particular case.
Sudhir Kumar, Advocate (Expert) 17 July 2024
