NI act

(Querist) 22 October 2009 This query is : Resolved
deat sir,
I have following queries
1) what questions should I ask from the clerk of a bank in his cross examination
adv. rajeev ( rajoo ) (Expert) 22 October 2009
There is nothing much to ask the bank clerk in the cross examination, because they give only memo of bank.
However you can ask about the inward and outward register in which cheque was sent for collection and received after unpaid by the drawe bank.
you have not given the details, if you were given the details i would have told you about the cross examination.

What defense u have taken in ur case? refering to that defenses only u have to cross examine. Also the denials of ur case should be denied in total, also while cross examination suggestion also u take, but all depends on ur objections.

Saini Sir!

Please come with the facts of the case. Are you talking about any recovery suit filed by bank or any NI Act case in which the witness of the bank has been summoned by complainant or in the matter of some other case in which he has been summoned just to bring his record or ..........or............

You please clear the facts and make us easy to reply your quarry.

sorry to interrupt the query is regarding NI act.

since the bank clerk is a official witness of record....nothing much can be extracted out of him, unless there is some default on the part of bank....which are better known to u.

IT DEPENDS UPON WHAT IS YOUR DEFENCE, IF YOU DEFENCE IS TOTAL DENIAL OR NOT LEGALLY ENFORCIABLE LIABILITY OR ANY OTHER DEFENCE.

Bank clerk is an official witness of record, just ask him about the genuineness of the record.
