We are in Thane, Maharashtra Our housing society is having 64 flats and some of the members are non-occupants and given thier flats on rentals. Can a non-occupant member become a working committee member and eventually stand for elections to hold a position as a chairman/Secretary/Treasurer ?

Do you think tenants should be the members of the society? Why do you feel that the flat owners should be deprived of the right to participate in the activities of the society? Society is formed by the owners of the flats for the welfare of the sociery as a whole to look in to the common and general interests of flat owners, whether they are occupants or non-occupants. When they are paying the maintenance and other society dues, why their right to be a member can be denied?

Though there is no such classification of occupant or non-occupant in societies act but in the general house meeting, this issue can be raised that if the non residing person are made office bearers of the society then its day to day working shall definitely affected adversely so resident members should be preferred for the posts. Even this issue can become an election issue and let the other members decide whether they elect residents or non-residents.
