Dear experts,

In a divorce matter, can we ask the court to send a notice to the bank to produce the details of a account of the second party ?

Tell the complete facts. Why you need details of other party's bank account in divorce case???

definatyely, u can, but it is better to elicit entire details in that regard, other wise u can't get sufficient advise, here it is not possible to get proper response basing on some kind of asumptions and presumptions which may lead to injury to ur case.

dear experts,
Pls do not take my purpose of asking in wrong way - I needed this info to prove the false allegation from my husband's side who has applied for divorce on the basis of dessertion and I have only one proof as his bank details where I am sure he has given our present address but I dont have his bank account number. So if the court can send the notice to the bank (I know which bank it is but I dont know a/c number) to send the address of my husband during the time he was staying with me. I have checked with the bank and they can provide all the previous addresses of a account holder but only on the notice of court. So in this regard, is it possible to request the court to send the notice to the bank to get the details(address) of my husband's account?

Yes. It is possible to apply to the Court for summoning of witness from the concerned branch of the bank to bring the record pertaining to the bank account. In banks, accounts are maintained with account number and also with names. You may give particulars in the application made to the court. Account opening form containing address as well as subsequent correspondence and change of address(es) may be summoned through the court.
