Dear members, We are the owners on the floor below, and a family above us has taken the flat on lnl agreement. There is constant stomping and running in the flat above resulting in cracks on our walls and disturbance throughout the day and even at night. We are senior citizens with health issues and as a result of the nuisance unable to rest at all. The running by some child is so strong that vibration comes on our floor and window panels too. What can be done as they were requested to behave In a more civil manner but they are not showing any compassion. Pls help thanks

It is unbelievable that your ground floor walls are getting cracked due to their movements in their floor or that your window glass panels are vibrated due to a child running in their house. Believe you are not able to tolerate the neighbors attitudes which are just common in the normal sense. If they are intentionally causing nuisance to you then nothing prevents you from taking action through the association or police or by issuing a legal notice. Just being a senior citizen you cannot restrict the freedom of your neighbours in their own house. If they are your tenant then you can terminate the rental agreement or inform the owner about their intolerable attitudinal behaviour. Remember at this age you need support and help from your neighbours and not their wrath or .hatredness

Yes, too fanciful a story devoid of any legal elements or issues therefrom. A child is after all a child. It is for the adults, that too senior citizens, to be sensible and reasonable.

Unfortunately even building ppl couldn't believe until they saw and experienced it themselves. We were very patient for 3 months but now it's happening even at night as late as 2am or 5am. If the child 10/12 years old has the right to play then we also have a right to rest or be in the house peacefully. Thanks

Please amicably solve the issue between you and your neighbour. If it is very nuisance you bring it to society's notice.

We approached the society and the owners of the said flat but still no cooperation despite society issuing a letter to them. Few members told the secretary too that they too heard the vibrations when they were at our house. The structure of the building is old and not well maintained.
