Hi,
I am living in a apartment from more than 2 years. Few days back my owner informed me that he wants to sell this flat so as he can invest the proceed in some other property.
As a result he want me to vacate this flat, I requested him to wait for some time as I bought one flat which is under construction and will be ready for possession in another 1 month time but he is adamant of me vacating flat without delay.
Please help me to understand how can I safeguard my stay in this flat till the time my bought flat becomes ready for possession.

Thanks,
Dhananjay

Issue him a legal notice stating that you are a lawful tenant hence he may resort to only due process of law and not to adopt any other illegal method to evict you by force.

What is the problem for you in shifting the house temperaorily till your construction is over. The owner might wish to sell his house for the reasons of his own.You are also going to shift to your own house and how would you feel when your tenant gifts with a legal notice Sort it out amickably and try to request the buyer whether he would extend time or simply co operate try to avoid litigations

Mr Author,
You made an agreement with the owner if you have any problem. but learn it tenant means not a share holder, the owner may file appeal or suit before ld court for recovery of khas possession for self need.

Do not worry. The landlord will have to file eviction suit to evict you ad the time taken to do that would safeguard your interest till your flat is ready.

What were the terms of tenancy. Was it through a Registered agreement or otherwise. If you are ready to bear the pressure, legally your landlord can not get you evacuated for one your minimum through court.

If do not want to bear tension, may shift your residence.

dont worry . you cannot be evicted without following due process of law . there must be clause in agreement for issue of notice for termination of leave and license

Mr. Dhananjay,
Where is the demised property situated?
Whether there is some written agreeement or not? If yes, for how much period you have taken the property and what are other terms and conditions?
What is the rent? Are you paying rent regularly or defaulted?
Whether it falls under the provisions of State Rent Control Act or TPA?
Give full facts of your case, rather it would be better to engage a local lawyer.
