payment of wates act

can a worker file a case who is getting Rs 8,500/pm, and not paid his salary for three months continuously? what is wage limit and what is the notification in this respect ?

He can file a suit after giving due notice, but what is the main issue

If he is a "workman", as defined in Industrial Disputes Act, without bothering his wage limit, he can move a complaint before the Assistant Labour Commissioner, who will depute Labour Inspector to the establishment for the recovery of wages. If the matter is not settled there and still you feel unsatisfied, you can move an application under Section 33-C-2 of the Industrial Disputes Act, 1947 for recovery of wages.

Under Payment of wages Act, you cannot recover because the wage limit is Rs.6,500/-.
