Private lawyer in criminal case from prosecutor side

Hi,

I lodged a FIR against a person who broke my leg. I lost the case in Court.

Now case is lying in the Nainital high court since 2008. Case is admitted over there and no dates has been given to that till now. I inquired with clerks and officers of the court and they are saying send your lawyer and we will list the case.

I have sent two lawyers(one after another) and both after taking the fees said they are not accepting non public prosecutor (private advocate) vakalatnama in that.

I am very confused how to proceed in that, please suggest.
Can we have private lawyer instead of public prosecutor?

This appeal is filed by the State against the judgment of acquittal of the trial court? So the public prosecutor takes care of the case. The case will be listed in a routine. what is the urgency for you? if you were not satisfied with the lower court judgment you ought to have filed a criminal revision against the acquittal. Were you not advised at that time? if time is there you can file now also. consult your lawyer whether time is there or if revision can be filed with condonation of delay petition.
