Proforma copy of an Agreement of Sale.

Respected experts,

Generally an un-registered Agreement of Sale is valid for a period of 3 years. I want a proforma of an Agreement of Sale, which validates even after a period of 3 years also, basing on the some terms and conditions. If possible, plz. forward the same. As I am in need of this type of proforma document.

Add the following terms and condition in the aforesaid agreement to validate it for more than 3 years:

"The Second party (buyer) has handed over today the entire sale consideration of Rs. ......... and the First Party (seller) has duly taken over the aforementioned sale consideration of Rs. ..........and nothing remains to be paid by buyer to the seller".

The possession of the property under agreement for sale (description..........) has been handed over by the the First Party (Seller) to the Second Party (Buyer and the buyer has duly taken over the possession of the aforesaid property after getting it duly measured/inspection conducted through ..........(architect/civil engineer etc).


That parties to the agreement undertake that as and when the buyer or in case of his death his legal heirs shall desire the seller or in case of his death his legal heirs shall get the registered sale-deed executed.


If you insert the aforesaid term in the agreement then the limitation of 3 years has no consideration and it is valid for ever.

Agreement to sell with possession amounts to sale and it requires registration with proper stamp duty.
