Proof of case pending

(Querist) 18 May 2016 This query is : Resolved
Hi,

Due to some reasons, I need to prove to my company that I have a divorce OP pending. How do I do that? I have certified copy of the OP but I don't want to submit that as it contains lot of personal things and also it does not say that the case is still pending.

The court section is refusing to give certified copy of the docket proceedings.

So what can I do to prove that there's such an OP and it is pending in court?

Thanks
Sudhir Kumar, Advocate (Expert) 18 May 2016
It is unbelievable that you are not getting certified copy of the court proceedings.

It is for you to decide why you have to prove to the company that there is divorce proceedings.

If you do not want to show available documents to the company the do not prove it. There cannot be a divorce case without any description of personal matters.

I have filed CA for docket proceedings and even after 4 months they are not complying. When I told the judge, she does not bother.

Apply for and get a certified copy of last date orders in which new date of proceedings must have been mentioned. Submit the same to company.

@Amit,
1. What is the purpose of informing/proving the company qua the pending divorce case?
2. What do you mean by the terminology used by you inter alia, that "divorce OP..."??
3. In the later part of the para you have submitted, "how do I do that" what did you want to say ?? it is vague.
4. "I have certified copy of the OP but I don't want to submit..."???? what do you mean to say???
5. What is your locus standie to the case, you did not mention?
6. What is the reason/objection raised by CA for refusal to provide certified copy of order sheet?? I agree with the expert analyses and questioning by Mr. Sudhir Kumar, it is unbelievable story.
Number of such other statements in the query which even cannot be presumed for forming an opinion and advise.
