Purchase of a floor of a building

i want to purchase the first floor of the house. the owner of the house lives on the third floor and he has sold the second floor to someone else. now he is giving me the xerox copy of the original deed and says that the original deed was submitted when he sold the second floor. the xerox copy does not have any detail of the deal of the second floor. so should i accept the xerox copy or something else is required?

Photocopy is not the safe bet as the property may e mortgaged with bank by deposit of title deed.

since the second floor has been sold earlier so should the original deed be with the initial owner of the building or with the owner of the second floor and if he shows me the original title deed so should there be a a mention of the deal of the second floor that it has been sold?

Yes, the visit it buyer and see the deed on your own eyes.

avoid purchasing said property . you wont have original title deeds in your possession . will be at mercy of seller

If you can confirm the original title deed with the buyer of second floor which duly mentions even the ownership of the seller of the ground floor which you are purchasing then there is no risk thereto but try to make the witness to your sale-deed to the buyer of second floor.
