Purchase of new flat

Respected sir, one of my friend had booked a flat in Noida with Amrapali develpoers and has taken loan from Bank. he has given loan amount to the develpoers but due to some reasons the project is delayed since last 3 years, but he has to repay the loan EMI every month. is there any solution to this so that he can stop paying EMI or take some compensation from developers to reduce the financial burden.

How can the bank disburse the entire loan amount before the completion??.. generally banks disburse the loan amount in slabs.

You can separately sue the developers for damages basing on all documentary evidences disclosing dateline for handing over possession of the property as well as progress of construction etc.

Lodge your claim for damages before the consumer forum for deficiency of services.

yes sir, the loan amount is disbursed in slabs only. but he has to pay the EMI today and the project is delayed too much .

how muc time the consumer forum will take to give relief in this matter

It is not possible to assess the exact time that will be taken by the Consumer Forum Orders.

Normally disposal of matters lying before Consumer grievance redressal forums take much shorter time in comparision to disposal of civil suits.
