Re non occupancy charges

I am paying Non Occupancy Charges to society since lats 2 years as I have given my flat on rent. Also I still do not have any reserved parking allotted to me and hence now finding difficult to find high rent from the property.
My question is is there any provision in society act/laws where we can deny/by-pass the additional non occupancy charges basis the basic COMMON SERVICES & AMENITIES ( like car parking) not been provided to me.

Sir,

Non-Occupancy charges are mandatory and you can not refuse to pay under any pretext.

Every member has to be provided parking facility under sections 77 to 83 of Maharashtra CHS Act.
