In property suit I am defendant ,suit is in the evidence stage ,I want to make application to dismiss the case on ground of non joinder of necessary party,
1- can I make this application at this satge,

2- if yes u/s & order by which I can.

Move an application under Order 7 Rule 11 read with section 151 of CPC. Court may accept your prayer.

Just an after thought.... were u not aware of the fact there are other NECESSARY parties to be brought on record in the suit at the initial stages when notices is served on u as a defendant ?
