Regarding awarding attendance in private universities

(Querist) 10 December 2010 This query is : Resolved
Is there any law that dictates the terms to award attendance to students in private universities by Govt. of India?

Because according to UGC there is a clause to have 75% attendance in a semester to appear for examinations. But teachers cut attendance for not writing notes, talking or sleeping in classes even though you are physically present. Can they legally do something like that.

Can we challenge them legally and win in case if we go to court.

Dear Mr. Anurag,
What will you plead in the petition that I was sleeping in the class, and I was not writing notes, and attendance should be given?
Anurag (Querist) 10 December 2010
Sir, we pay nearly 2.5 lakh per year to study hear and is it not my wish whether I study in the class or not.

We pay them to teach, if we don't want to write in the class is it not my wish.

When we buy a ticket to a movie, even when we go to watch the lst one minute they will allow, why will the teachers not let us in when we go late.

I used to respect teachers a lot, I have been in hostel my whole life but never cursed any teacher/school authorities.

But in college the teachers try to boss over us they threaten to cut attendance or marks even if we smile in the class. They are immune to reason and don't have even little courtesy towards students.

In India since long, teachers were treated as gods. I don't see the point. They should earn respect but not expect it just because they are 'teachers'.

Please suggest me if there is any law.

The other day I did not write the last topic he said in the class. For that he cut my attendance and shouted at me. With just 5 minutes left in the lecture he sent me out. When I tried to explain he threatened to cut my marks.

Best of Luck.

Sir, will the above argument be sufficient?

It is more a matter of discipline than law.

You seem to think that since you are paying money you can do whatever you want in the class. Can you say that you must be promoted without writing the exams since you are paying money for that also. There is no law permitting such a thing in India.

Mr.Anurag has infact exposed the practical scenario prevalent in the Education system. Sooner or later the situation mentioned by our experts cannot be ruled out and even litigations related to attendance prescriptions as explained by the querists will be tested and tried by the competent courts.

You will loose your career if you sleep in the class. It is the duty of the Teacher to correct you buy using any reasonable means. You have to appreciate them for doing so.

But, they can not reduce your attendance. It is illegal. Challenge it before the authorities, and then to the HC.

Mr. Subramanian

You have got me completely wrong.

I am not saying just because I pay money I can do anything. Thinking like that is arrogance.

This is the very reason I put this question up before proceeding further. All elderly think like you. The point is a teacher is no more thought in our time as someone who is a beacon of light or someone who gives us a better future.

They don't do it any more to serve society, they do it because they are getting paid for that.

Even if I see any teacher from the college on the road or a place I don't wish them because they are worthy of giving our respect to.

You have been commenting on my thoughts. This is the point. Nobody understands from the students point of view. Since the teacher is elderly he/she is right.
I think this is the verdict I get even if I go to court right?
