well, i would like to know the stamp duty fees for obtaining succession certificate and how it is calculuated.

For obtaining succession certificate, you need to file a suit in a city civil court. You would be the plaintiff and 'nil' defendants. With the plaint you need to produce all original documents in support of your case. The court would order for publication of an advertisement in a daily news paper inviting objections if any for issue of succession certificate to you. Then you need to give evidence. The court would pass an order declaring you as the successor to the properties of the deceased. Then, the court would issue a certificate to that effect on a stamp paper (in Karnataka, it is done on a Rs. 2 stamp paper called document sheet)for which you need to pay a court fee applicable in your state. In Karnataka it is about 6% of the value of the property for which you are declared as successor. This certificate need to be registered in the Sub-Registrar's office for which registration charge is 1% of the value of the property. Time taken to complete this process may vary from six months to one year. However, this is the pucca method of succession in accordance with law. No body can doubt the validity of the certificate.
