If A purchased a commercial property situated in New Delhi from B in 1999. A paid transfer amount 3% of the consideration to MCD for getting property mutated in his name in 2003. Now A wants to get agreement to sell registered in his name and B is also ready for the same by paying 3% remaining stamp duty. But somebody told A that amount paid to MCD will not be adjusted in stamp duty as it is paid after 28.09.2001. Is there any circular/notification or rule?

Dear Umashankar,

Please explain some more facts.

1. A already purchased that property thorough the Sale Deed from B?
2. Wheather A Mutation Fee of 3% or Stamp duty of acquired document?
3. After purchased property from B, subsequently A want to agreement to Sell with B, Why?

Thanks a lot.

Actually the property belongs HUDCO earlier. Later the property was allotted to some company on the basis of perpetual lease deed. The company (B)allotted one unit in said complex to A. Registration of the said property is not done and is not possible as that is under mortgaged. So A want to get agreement to sell registered.3% of consideration amount has been paid to MCD as stamp duty or transfer charges for the same document.
