Release deed

(Querist) 28 December 2015 This query is : Resolved
Sir,
I have purchased an apartment in Navi Mumbai jointly with my wife. My name is second in the agreement.
I want to release my right in the property in favour of my wife, without any monetary consideration. Her name appears first in the agreement. We are getting legally separated.
Please let me know the procedure for release deed, and also whether it is necessary to register the same.
Thanks in advance.

You can do so by way of execution and registration of one deed of gift/relinquishment in favour of your wife whereby your half share in the property will go in the name of your wife making her absolute owner in respect of the said property.

1) Either gift or release deed
2) Better register in interest of both to avoid claim from either

For drafting and registration of the relinquishment deed, consult an advocate of your area.

Sir,
Is the divorce decree, after being issued by the family court, required to be signed by both, husband and wife?
In case of jointly owned property, Is it necessary to execute the release deed, before the divorce decree is issued or after the decree is issued?
Devajyoti Barman (Expert) 29 December 2015
Decree of divorce can not transfer the property between the couples not such decree is required to be signed by the parties.
