I am working in a private company. There is no any agreement between me and the company. I got a better opportunity. I tendered my resignation and requested to relieve me. But these people are not relieving me. My new employer is asking for relieve order.
I want to know the legal position as what remedy I hv?

Issue a legal notice through advocate.

pending the outcome of the legal notice,you may communicate to the new employer the position in writing.
if your new employer is also a private one,they may not entertain you.

You produce the resignation letter and its proof of delivery to your new employer, he will understand the situation and will not press for the relieving letter.
It is your duty to give a proper resignation letter, if the employer is not ready to relieve you, you need not worry.
