Residential society issues

(Querist) 17 February 2017 This query is : Resolved 
Sirs,
there has been many discrepancies in the accounts pertaining to the flat we own in Thane. Society does not respond to the queries we raise. on recent visit to followup on my case registered with Registrar's office, he says there is no power in him to take up issue. I was told to approach Corporate court to file case.
Please give me your expert opinion and if so a good experienced lawyer in society matters that can take up this case.

Sir,
Demand a written explanation from the managing committee of the society about the accounts, and if the managing does not reply or if the reply is not satisfactory you can submit a written complaint, under Appendix 28 of Bye-Laws of CHS, to the Registrar, the registrar has to attend to your complaint as per section 174, which states as under:

If the Member/Members are not satisfied by the decision of the Committee or does not receive any communication from the committee within 15 days, the complainant Member may approach below mentioned Competent Authority.
174(a). THE REGISTRAR
i. Complaints to be made to the Registrar. Matters pertaining to following issues :-
174(a) viii. Non supply of the copies of record and documents,
174(a) ix. Tampering, suppression and destruction of the records of the Society,
174(a) xi. Non maintenance or incomplete maintenance of records and books of the Society,
174(a) xvi. Reconciliation of Accounts,

If the registrar does not attend your complaint you can take recourse to RTI application.
