This query is : Resolved
A Treasury Department FOOLED the Applicant and the Information Commission by giving false information in response to a Order in Appeal was passed by the Information Commission in the year 2007.
The Appellant not satisfied with the Treasury Department information filed a Civil Suit in trial court on the same subject against the Treasury Department. The Suit was for recovery of some revenue.
The Treasury Department once again submitted the same false information in its counter affidavit in a Call for Records / Documents Petition in the course of trial in the suit.
The Appellant / Plaintiff in the year 2012 managed to get the correct information from the Auditor General of India and other relevant information from the Treasury Code.
The Treasury Department has come to know that the Appellant has gathered all relevant evidence against them and deliberately delaying the proceedings in the suit on some pretext or other.
Now (year 2013) my query is can the Appellant / Plaintiff bring to the Notice of the Information Commission the wrong doings of the Treasury Department and make the Information Commission pass order to the Treasury Department to furnish Correct factual Information during the pendency of civil proceedings ?
How will the Information Commission be helpful at this stage ?

You can file a complaint to the Information commission.
At the same time you can file a petition for perjury in the same civil court.

Definitely such information in the shape of a complaint should be brought before Information commission with prayer to initiate strict action as per its provisions.
