Sale deed void - no consideration

Dear All,

I sold my property @ 20 lacs but one cheque which was amount to Rs. 2 lacs which was entered into the sale deed was not given to me by the Buyer. I signed executed the sale deed in favour of the buyer and give possession. I sent notice but no reply.

Can i file sale deed cancellation in civil court?

Usually it is stated in the sale deed that amounts/instrument of payment (mentioned in sale deed) have been received.

You may show the sale deed and notice sent by you to an able counsel specializing in such/property/civil matters and proceed further under expert advise of the counsel.

Send notice for payment through draft against this cheque.

Discuss with local lawyer.

Issue legal notice through a local prudent lawyer for cancellation of sale deed for non-performance and non-payment of consideration.
