sale of flat

Querist : Anonymous (Querist) 19 February 2010 This query is : Resolved 
we want the flat which belong to my late father. we are 2 brothers. the buyers lawyer has asked us to give consent letter in order to transfer our name in society record. however he have asked 2 separate letters from us. why separate letters and not single letter?
Also if separate letter has to be submitted by each of us then why I have to declare / oath regarding the heirs of my brother? pls comment.

Except for waste of stationery, it would not matter for you whether the consent letter is given jointly or severally. If that advocate is happy by receiving two separate letters go ahead and give it.

Single consent letter executed jointly will serve the purpose if the Rules whereby the Society is governed does not provide otherwise. Generally no legal provision ever makes such provision that separate consent letters are to be given when the persons giving consent are similarly situated. You may ask the lawyer of the buyer to spell out the reason as to why he wants so.

There are no such laws demanding separate consents from legal heirs single letter with consents from all legal heirs will do.
