Sale through poa

(Querist) 08 December 2012 This query is : Resolved 
i have sold my flat through POA and sale deed before Supreme court order. but cud not do registration in time. Now the purchaser has slold it to third person again through poa and sale deed. but now society is saying it is not legal. they are asking for registered documents and not allowing the third owner to enter the society. They say that as per their records, still i m the owner of the flat and I have to paye maintenance/renovation fund to society. How to resolve this ? Pl. help.

You seem to have already sold the flat. In that event it is immediate seller of the current owner is liable for making good the loss, if any.

But society is sending me letters for renovation fund and maintenance? What should I reply to society ?

You are not liable for any charge at all. Ignore such letters.

It seems that you lack the knowledge how to tackle the situation for your own interest. As the cost of property has raised many times and maintenance amount etc. is pending against you being your legal ownership over the flat. let the ultimate buyer come to you for your help. The subsequent buyer has sold the property to third party on the basis of POA so buyer is liable to pay. You need not worry.
