Sale while suit pending

“X” is a registered owner of an agricultural land . One “Y” has filed a suit of cancellation of sale deed and permanent injunction and partition of the said land on the basis of some alleged documents after 15 years . The court has not granted any stay order on the said property . The “X” is in need of money . Now my query is , Can “ X ” the said suit property to a third party when the said suit is still pending . What will be the legal consequences ?

has lis pendens been regd?

since no stay has been granted you can sell the property but it is better to inform the purchaser of pending litigation

before selling the property to others explain the whereabouts of your stand on the property and the litigation and proceed
