Selection list

(Querist) 19 April 2013 This query is : Resolved
Our selection for the position of court managers was finalized by Public Services Commission last year in the month of July. As per the notification our appointment orders were to be issued by Department of Law and Justice, However, Law department forwarded the list to State High court for issuance of Appointment orders. The State high court got our medicals and verification of antecedents done by the order of Registrar General of high Court. However, our formal appointment orders have not been issued since last year almost 7 months back.

What is the legal remedy available?

Has the formality of verification of character and anticedents been completed or not? That is a must for appointment.

Yes the verification and medicals have been completed and submitted 7 months back. We also wrote to the law department to issue our orders as per notification but to no avail.

I no reply to your reminder has received despite of serving of legal notice, no remedy remains with you except to file a writ petition before high court.
Umar (Querist) 23 April 2013
Can we file a writ directly in the supreme court under article 32.?
Raj Kumar Makkad (Expert) 23 April 2013
Why do you want to over pass High Court?
Umar (Querist) 24 April 2013
Because, high court is the party to it and also because of delay tactics they use under political and administrative pressure.
H.M.Patnaik (Expert) 26 September 2015
No,in the instant case you have to move suitable writ petition before the High Court and in case you are aggrieved by the judgement passed, Supreme court can be approached for redressal of your grievances.

I agree with Dhingra Ji.
