Share of property of grandfather to his grand son

(Querist) 25 August 2013 This query is : Resolved 
a young woman having minor child is living separately from his husband since last 10 to 11 yrs. the husband income is only 6000/- per month as he is a driver of a petrol pump owner.the woman is dependent on his father's support.Her father-in-law has a huge property worth 2 crores rupee.10 years ago her husband gifted his house to her after a panchayati divorce. her father in law expelled both of them from property right through affidavit.both filed mutual divorce twice in the court but the court rejected divorce on the ground that her son be given share of his father's property. how the woman can gets her son's share from the property of his father or grand father...?please suggest accurate procedure...

If the property of the grand-father is self acquired, grand son can do nothing during the life of his grand father and even after his death, the property shall devplve upon the legal heirs of deceased as of their personal property and in that event also the grand-son cannot get any rights therein.

It shall be better to settle the issue amicably instead of legal rights enforcement.

How has that huge 2 crores worth property come in hands of her father in laws'hand is a vital fact to be told by you for proper answer.

father in law of the woman was Dy.S.P during the days of terrorism.....in Punjab....that's why he acquired huge property...may be by illegal means...

The property is self acquired by the father in law of the lady. During his life she can not claim any thing. In the period of his life FIL gift, sell or make a will property would move accordingly. If not done so, it would be distributed among all the legal heirs of the deceased.

You have clearly mentioned that the property is self acquired so no claim can be made during the life time of that person.
