My building went it for a platering works were society has demanded 40,000/- in installment from each tenant. this was for April 2007 to March 2009, later on society also passed a resoulution of Rs.500/- monthly penalty for late payment instalment. Due to financial obligation some of the tenants delayed in making the payment, . society is demanding a penalty of Rs. 500/- monthly for the delayed instalment.
i have made the entire 40,000/- on 1 sept 2008 for the period 1 april 2007 to 31 march 2009. though before the commencement of plastering work. The society is demanding 5000/-penalty for the delayed in instalment. They are also threating to send 3 notice and then will force the registrar to take charges and with this they shall have the right to seal my property as they have informed. kindly advice what should i do. when i get the 1st notice and then there after.

Society can not arbitrarily take your matter. Though for some of the months, your payment is delayed but on the other hand it is also made in advance for rest of the months.
If the society is adamant to charge interest on delayed installments and the same treatment they cannot deny you on advance payments. So you issue notice to the society to provide you rebate or refund in the early paid installments on the same footing means @Rs. 500/- per month.

Mr. Raj Kumar do i have to approach a advocate to send a notice or a letter from my end will serve as a notice to them. what wil i do if they approach a registrar for this collection. since its a legal matter . Approaching an advocate will be more costly isnt it!
They have already added this Rs.5000/-penalty in my maintenance bills. however my montly maintenance is nill. from next month it will show outstanding. after 3 month again intrest will be charged.
