Society registration act

(Querist) 16 September 2013 This query is : Resolved 
We are running a charitable society registered in Delhi under Society registration act since 1995. We have worked for various acitvity in Delhi for social cause. IT IS RUNNING ON DONATION AND MEMBERSHIP FEES ONLY. Now we want to run a charitable dispensary/hospital at Loni OR SOME OTHER Interior VILLAGE in UP to provide health service free of cost/at a nominal fees. Kindly advice:
1. Do we need to reregistered this society at National level a society or we can start our dispensary/hospital without any registeration at national levl.
2. Do we need to take approval from health department/ministry of UP for the same.
3. Do we need to follow some other formality for the same.

1. Your society registered at at Delhi is sufficient to do the welfare work at any prts of India according to your memorandum.

2.Yes approval of health department running the Govt. is required.

3.keep proper books and account and get your socaity register under the Income Tax for exemption.

Dear Client,

In future if you want to expand the charitable activities to other parts of India as well, then you better get it registered under Indian companies Act with the Registrar Of Company's and running your company for only charitable purposes and not for profit motive etc maintain proper books of accounts etc in order to claim IT exemptions as per condition laid down in section 11 of IT Act 1961.
The income of such public charitable trust should be invested in recognized modes only such as immovable properties, recognized Company
Deposits, recognized Government Securities etc as per section 11(5) of IT Act 1961 in order to claim full exemption from income Tax under IT Act.
