Stamp paper

(Querist) 09 July 2014 This query is : Resolved
I have entered into an sale agreement with a builder to buy a flat.
There are 2 mistakes/typo errors on the main stamp paper . The first party name is not mine and the building name has been mention as Tower B Sheekhar instead of Tower A Sannidhya.
All subsequent pages have the correct first party name and address.
I pointed to this to the builder and he says that as long name and address is correct in the subsequent pages there is no issue. Moreover he says this document is null and void once the Dastavej is done where he shall ensure correct name and address.

1. Ensure that such mistake does not occur while making the sale deed. The mistakes were made in the agreement to sell and the mistakes done by oversight need not be now rectified n such agreement to sell.

If meanwhile any dispute arises then you will find difficuly in court with respect to the error. Go for rectification of error & enter into fresh agreement of sale either it is registered or unregistered & in the fresh document mention regarding the error crept in earlier document.

The error may be brought in the notice of the builder in writing with acknowledgement, Builder may advise by letter that he would take care at the time of sale deed to rectify the error.
