Temple trust

My friend 1s temporarily running a temple which was constructed under the land belonging to Electricity board.This temple was constructed 15 yrs back and he is running the temple with 4 of his friends . Electricity board does not object to the temple activities inside their campus which was built with public funds.
Now all of them want to float a trust for the purpose of running the temple as the land may not be transferred in the name of any of them running the temple.Running of the temple is being unofficially done and the temple has become of late quite popular among the public.
Is it possible to form a trust with a sold aim of running the temple without prejuidice to the Electricity Board's rights to take back the land as the temple was constructed by the public.
The sole aim of the the trust so formed will be to run the temple legally and in the process collect donations legally and account for it for the development of the temple and its activities.Now they are doing it in a small way unofficially with the help of funds from the public.

Find the nodal department that registered the trust in your state,
Apply there,
Electricity board through his officer as they choose, must be the member trustee,
The way the donations to be used must be defined,
Try to have transparent activities.

You create a Public Trust For the Temple
under the Indian Trusts Act and one of the trustees should be Electricity Board employee. Managing Body of the Trust is accountable for the Management and affairs of the Temple. But regarding transparency and accountability you should be prepared to show your P&L account and Balance e Sheet Etc to the public or conduct External Audit and results published in New Papers . The temple on the electricity land is illegal and liable to get shifted anytime. Get the title first before getting the trust registered. Check the endowment law of your state.

I agree with the experts.
Since the temple management is getting good amount of donations from the public (being popular) it would be better to engage/ employ/retain and seek professional services of a lawyer, instead of use of this platform meant for the benefit of general public who are unable to afford paid legal service.

Creating trust is not a big issue. It can be created and be got registered as desired, however, without written permission of the electricity board, the public land cannot be taken for such activities. Ensure if possible that temple activities shall not be intervened.
