Respected sirs
My tenant has not paid rents since 15 months and I have issued a notice to vacate. But he has not vacated and I have lodged a eviction case where he appeared and gave arrears rent in cheque to court. Even That cheque has returned. What effect this has to the case.

if the cheque bounced you can file NI138 case against tenant separately, and mention before the court.

Inform the court about dishonor of cheque.
Send notice for dishonor and file case u/s 138 NI Act.
Also can file cheating case.

Tenants cheque for arrear of rent,if bounced,it proves ground of default in making payment of rent.eviction decree against tenant can be passed on this ground alon.

I agree with the views of expert Mr. Goyal on the subject issue. The bouncing of cheque for the payment of arrears of rent will be an evidence supporting the prosecution of eviction suit unknowingly submitted by the defendant who dug his own pit by such an act. This itself is a strong ground to seek early disposal of suit in your favor for evicting the tenant.
