Tenant rights in a pagdi system bldg.

sir,

we stay in a pagdi bldg since last 50 yrs. builder wants to redevelop the old building but not giving any detailed info about the same.
what r the details to be asked and docs to be received from our buider cum landlord cum developer and wot r the benefits we are eligible to get from him before vacating the place? also, property(room) in the name of my late dad. owner asking for money for tranferring the same in my sisters name.

can the landlord evict us forcibly without giving us any benefits? can we take a stay from the court?


pls advise?

you can demand compensation and also you can go to court for stay

your dad was a bonafide tenant for last 50 years . on his detah his legal heirs who have been staying with him would be tenants . the landlord has to accept the legal heirs as tenant . if landord is not trnsferring rent receipt in name of legal heirs file suit in small causes court for declaration . hope you have been paying rent on time .

in case property is redeveloped your family would be entitled to room . lanlord can redevlop property on getting tenant approval

You cannot demand compensation as a matter of right. You are a legal occupant of the premises and therefore, the builder may evict you only after following due process of law. It means, he need to issue a quit notice and if you do not quit, he has initiate legal proceedings against you for eviction which case may run for years.
