Trade Union Reference before Industrial Court is pending. Interim order in this Reference challenged before High Court. The High Court directed Registrar of Industrial Court to hold elections. He initiated the process also. Meantime, Letters Patent Appeal challenging the order of Single Judge directing Registrar to hold election is filed. Presently, there is no stay on election. In this situation, whether General Body of a Trade Union can appoint election commissioner and hold elections of office bearers?

As there is no stay against conducting of the elections hence the already going on process shall be finalized.
